Kenya: High Court - Ruto Cannot Give Teachers, Police Priority in Affordable Housing

A Nairobi High Court has put the brakes on one of President William Ruto's signature housing promises. The court ruled that Ruto's public announcements giving teachers and police officers priority access to affordable housing units carry no legal weight when they conflict with the criteria already set out in law.

The ruling is a significant check on executive power, making clear that presidential declarations, however well-intentioned, cannot override established legal frameworks governing how affordable housing is allocated. In short, a speech is not a policy.

What this means practically is that teachers and police officers hoping to benefit from their head of state's promise may now find themselves back in the general queue, subject to whatever criteria the law already prescribes. For many of those workers, it is a disappointing turn after what felt like a direct commitment from the top.

The case puts Kenya's affordable housing programme, already one of the more contested elements of Ruto's agenda, back under the spotlight. How the government responds, whether through legislative channels or a formal policy shift, will be worth watching closely.
